  • Mistrial in Michael Dunn murder trial

    Link

A Florida jury found Michael Dunn guilty on four of the five charges in a case in which he was accused of shooting a teenager to death over loud music, but they could not come to a decision on the murder charge and a mistrial was declared on that count.

Dunn, 47, had faced a first degree murder charge for the shooting death of Jordan Davis, 17, in a Jacksonville convenience store parking lot on Nov. 23, 2012.

The judge had instructed the jury that they could consider lesser charges, including second degree murder, manslaughter, justifiable homicide or excusable homicide, but they said the could not come to an agreement on any of those charges.

    ...

Dunn testified that he feared for his life and thought Davis was going to kill him, prompting Dunn to pull out his gun and fire nine times at the car that the teenagers were sitting in.

    ...

In his closing argument, Dunn's attorney Cory Strolla said that his client had a right to "meet force with force." He said the state has the burden to prove that Davis didn't brandish a gun at Dunn, as Dunn has claimed.
I hope they try this moron again and find a jury with working brain cells next time.
Dunn walks over to the car, begins the altercation and then goes back and shoots into a car full of kids who were basically just being kids.

Hopefully the judge will at least make the sentences run consecutively. This guy should be in jail the rest of his life.
    We are so fucked.

    The state overcharged.

2nd degree murder would have gotten a conviction.

According to the article, the judge gave them the option of 1st, 2nd, manslaughter and others.

Yes the state overcharged with 1st as there did not seem to be premeditation to support that. Unfortunately all we will hear in the media from the usual suspects is how it is open season on blacks and in this case I can't say I disagree with them too much.

Yes the jury had the option but there is an entirely different case and standard for 1st vs. 2nd degree murder. You are correct.

His version of events is plausible, but he blew it by leaving the scene and going to a motell for the night before contacting police. Had he remained at the scene or nearby then he could have directed the police to wherre he believed the weapon was dumped.

The second he left his car to tell the kids to turn the music down, he became responsible for everything that followed.
IMHO it would not have mattered if the kids had Uzi's and a grenade launcher, he had no legal right or status to return to the car a second time and open fire. His being offended at either the loud music or their refusal to obey his wishes grants him no right to even approach the car let alone fire blindly into it any more than you or I need to submit to a request to turn off or turn down our listening choices.

This gets more ridiculous when you consider that he was at a gas station and would be on his merry demented way in a couple minutes and left what he found offensive and ultimately fatal to the kid, behind him.

All this ultimately does is give the anti-gun crowd more ammunition against legal responsible gun owners and on that basis alone I hope Mr. Dunn rots in prison for the rest of his worthless life.
            We are so fucked.

The anti-gun crowd is unconcerned with facts as a rule. They don't accept the verdict in the Zimmerman case, so why would they accept the verdict in this case? They are irrational.

An adult has a right to tell kids to behave themselves. He doesn't have the right to shoot them if they don't, but the point at which they threaten mayhem is the point at which they cease to be "kids". Those car stereos are emblematic of a fuck the world mentality. Hopefully this case will cause the owners of such stereos to be more considerate.

Too many choices for the jury. Overcharged, and should have focused on no more than 2 options.

Maybe if the black community would start holding black men accountable for their behavior, this wouldn't keep happening. But no... that's too fucking hard and not lucrative enough.

What a stupid remark. My approval has less to do with melanin than it does noise. Don't get me started on poorly muffled motorcycles and stock muscle cars with Texas trash-boys behind the wheel. I swear that Mustang and Charger must be discounted for assholes.
